Privacy Policy

This “Privacy Policy” explains how CardFree (“Company” or “we”) collects, uses, discloses, and otherwise processes personal data on behalf of our customers – typically, merchants (any, a “Merchant”) – in connection with our application, CardFree Loyalty, which runs on the Clover Point of Sale system (“Clover POS”). This Privacy Policy does not apply to Company’s privacy practices in any other context.

Company’s processing of personal data in connection with our application is governed by this Privacy Policy and our agreements with Merchants. In the event of any conflict between this Privacy Policy and a customer agreement, the customer agreement will control to the extent permitted by applicable law.

This Privacy Policy is not a substitute for any privacy policy that a Merchant may be required to provide to their customers, personnel, or other individuals.

Importance of Your Privacy.

At CARDFREE, your privacy is of great importance to us.  We understand that you entrust us with certain personal information to help us provide various products and services.  In exchange for your trust, you expect and deserve our commitment to treat your personally identifiable information (“personal information”) with respect and in accordance with this Privacy Policy.  Rest assured that we will protect your privacy.  Under no circumstances will CARDFREE sell or share any personal information about you to or with any person or organization except (i) as authorized by you, (ii) as described within CARDFREE’s Website (www.cardfree.com, the “Website”), (iii) as described within CARDFREE’s software in various merchant applications (the “Software”), (iv) in connection with providing various products and/or services to you (the “Services”), (v) as may be required by law or court order, or (vi) as otherwise set forth herein.  This Privacy Policy below describes the standards we adhere to in handling information about you and any personal information you submit in connection with the Services.

PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE SUBMITTING ANY INFORMATION TO CARDFREE.  BY SUBMITTING ANY INFORMATION YOU ARE ACKNOWLEDGING THAT YOU HAVE READ AND UNDERSTAND THIS POLICY AND THAT YOU AGREE TO BE BOUND BY ITS TERMS.  IF YOU DO NOT AGREE TO BE BOUND BY OUR PRIVACY POLICY AND WEBSITE DISCLOSURES, PLEASE DO NOT ACCESS OR USE ANY OF OUR SERVICES.

Special Note about Children.

Children are not eligible to use our Services and we ask that minors (anyone under the age of 13) do not submit any personal information to us or use the Services.  CARDFREE does not collect or maintain information from those actually known to be under the age of 13, and no part of CARDFREE’s Website or the Services is structured to attract anyone under the age of 16.  Other age restrictions may be set forth in other CARDFREE policies from time to time.

CARDFREE operates its Website, the Software and provides the Services to users in the United States.

Information We Collect.

We may collect personal data from or on behalf of Merchants. Merchants determine the scope of the personal data transferred to us or that we collect, and the information we receive may vary by Merchant. Typically, the information we collect on behalf of Merchants includes:

Information that Clover collects when a customer for a Merchant makes a payment:

When a customer makes a payment via a Clover POS, w ceollect information about the transaction, which may include personal data. Information about transactions includes the payment card used, name associated with the payment card, the location of the merchant’s store, date and time of the transaction, transaction amount, and information about the goods or services purchased in the transaction.

We may collect additional information ancillary to the payment. This information may include:
  • Customers’ phone number, such as when the customer chooses to enroll in CardFree Loyalty
  • Customers’ marketing preferences, such as whether the customer wishes to receive marketing communications or newsletters
How we use the information we collect

We use the personal data we collect for or on behalf of Merchants, to provide our services and the functionality of our application: We use phone number to identify loyalty members to present loyalty offers and discounts to the customer and to assign transaction points.

We may also use personal data for related internal purposes, including:

  • To provide information about the application, such as important updates or changes to the application and security alerts
  • To measure performance of and improve the application
  • To respond to inquiries, complaints, and requests for customer support

In addition, Company may use personal data as we believe necessary or appropriate to (a) comply with applicable laws and lawful requests and legal processes, such as to respond to subpoenas or requests from government authorities; (b) enforce the terms and conditions that govern our application; (c) protect our rights, privacy, safety or property, and/or that of you or others; and (d) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

How we share information

We may share personal data that we collect with:

  • The Merchant from whom or on whose behalf we collected the personal data
  • The platform on which our application runs, the Clover POS. You may view Clover’s Privacy Notice here.
  • With third parties as a Merchant may direct
  • With third party service providers that help us manage and improve the application
  • With Company subsidiaries and corporate affiliates for the purposes described in this Privacy Policy or in our agreement with a Merchant
How We Use the Information We Collect.

We may use the information you provide, either directly or through third party service providers.  CARDFREE may also share certain aggregated data with other third parties for general marketing and demographic purposes; however, this data does not include any of your personal information.  Some of our Services may be offered in conjunction with partner companies, affiliates or other companies or their websites with which we work.  In order for us to provide the Services to you, it may be necessary for us to share your personal information with one of such entities.  These parties are not allowed to use personal information except for the purpose of providing the Services.  If you do not want your data to be shared, you can choose not to allow the transfer by electing not to use that particular Service.

In addition, CARDFREE will disclose information where necessary to provide the Services, or as required to respond to lawful requests from public authorities. For example, CARDFREE may disclose account or other personal information when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with CARDFREE’s rights or property, other Website users or anyone else that could be harmed by such activities.

Actions Regarding Information You Submit.

(i) Deleting Your Information.

Federal and state regulations may require that we store questions or submissions for various periods of time.  In order to comply with these regulations, we may be unable to delete information from our databases.

(ii) Request To Stop Receiving Emails from Us.

Periodically, CARDFREE may send you emails to alert you to various opportunities or offers.  If you do not wish to receive any of these offers, please send an e-mail with such request to support@cardfree.com.

Information Security.

CARDFREE has developed security protections and control processes to help our customers ensure a secure environment for their information. Independent third-party experts have confirmed CARDFREE’s adherence to high industry standards. We provide our customers compliance with industry standard security standards and technology to protect your personal information over public network transmissions to the CARDFREE platform.

Unfortunately, no data transmission or storage system is guaranteed to be secure and we cannot guarantee absolute security of the transmission or storage of your personal information. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please immediately notify us of the problem by email to support@cardfree.com.

International Data Transfers

Please be aware our products and services are provided using resources hosted wholly on servers in the U.S., so our service area does not currently include any services for users who are remote citizens of, or have residence within any European Union locations.

This warning is provided for those using our services, since information will also be transferred and processed by third-parties outside the user’s country where specific EU data protections apply, including to countries outside the European Economic Area (EEA), where the level of data protection may not be deemed adequate by the European Commission (i.e., where there are fewer rights in relation to your information).

Notification of Changes to Privacy Policy

If we make a change to our Privacy Policy in the future that will affect how we treat your information, including personal information, we will post such change to the Website.  The revised policy will be effective at the time we post it to the Website.  In addition, if we propose any substantive changes to the policy, we will provide you with at least thirty (30) days prior notice of such change.  In that case, your ability to opt out of the new policy will be determined by applicable laws.

Business Transfer and Succession

We may, in the future, sell or otherwise transfer some or all of our assets or equity to a third party.  Your personal information and other information we obtain from you via the Website may be disclosed to any potential or actual third party purchasers of such assets or equity and may be among the assets transferred.

Links to Other Websites and Applications

In connection with the Services, the Website, Software and communications may contain links to other websites or applications that are owned and operated by third parties that are not affiliated with us.  When you use those links, you leave the Website, Software or application on their device, and we are unable to control how the owners of the other websites or applications you link to handle any information they gather about you, including their privacy practices and use of cookies.  This Privacy Policy applies only to the Website, Software and Services and does not govern activities on non-CARDFREE linked websites or applications.  We encourage you to review the privacy policy of any other website or application you visit, download or access to understand its owner’s practices on how it collects, uses and discloses your information.
